Cross-Border Investment

This session will explore some of the main legal issues and challenges in drafting cross-border contracts in the dynamically evolving field of international commerce. These include some commercial aspects of contracts as well as the choice of law, forum for resolving disputes, and alternative dispute resolution methods. The panelists will also discuss ways in which to mitigate risks that might arise from these issues and challenges. Potential topics: (a) What commercial terms need to be considered – e.g. force majeure clause, limitation of liability clause, and international trade terms for different types of the contracts (b) Choice of law and forum for disputes – learning from case studies (c) Alternative dispute resolution methods – selecting the best techniques
