Dispute Resolution and Arbitration

This session will discuss the intricate difficulties of coping with privilege issues in the context of cross border disputes, in particular with regard to the different approaches in common and civil law jurisdictions to these issues and the solutions offered for the draft IPBA Guidelines on Privilege. This interactive session with round table discussions will take a broad approach to the sources of privilege, including the impact of data protection laws and privilege on documents submitted to government authorities in investigation proceedings which were prepared for the sole purpose of administrative actions.
